my image Tintin deleted

I am not a specialist in discussions but I will try to launch one about the small problem of my image "tintin" erased. It seems that she is disturbing a member because a design is there. To be clear, my approach is the following: I like these photomontages, the original idea being this house tintin which is my neighbor, I found interesting to show the work of documentation of Hergé, through a montage drawing / reality. Then I got caught up in the game and decided to try to find every week a solution to integrate the adventures of tintin into the weekly theme. I specify that the image is taken in one of my old albums, so via my lens and it is a digital photo. I then take a picture of a real place and mix the two to finalize my idea. In the last image posted on Tooka, I proceeded in the same way, except that I was obliged to treat 3 images: the reproduction in the book, an appropriate landscape, and a statuette, at least 50% of the result Is a standard image. What is the difference with images containing a book, a poster, or a bottle of beer? Everything always passes by the objective! I call it a photographic process ... I would like to have your opinion, and I would also like the people who are disturbed by this approach to come forward ...

Paweł Kadysz These are all **photos** of books. That's the keyword here.

Katrina Yu I think @Ron did specify that Tintin's images are taken thru lens via camera thus it is a digital image. A "photo" of a page from a book.

Marek Szymczuk You should make something like this - blog.logomyway.com/wp-content/... - but without using of Photoshop. Hold a real comic book instead of photo.

Tookapic is about photography (not about photomontages). This is my personal opinion.

jazzie The rules say that photomontages are ok. I really like your Tintin-project and am surprised that after you have uploaded so many pics now it suddenly it is not ok any more?! I think such querky interpretation of rules, especially on such an 'old' project, is just irritating. I always thought Tookapic was about making things possible, not about forbidding them?

jewels I have to absolutely and fully agree with @jazzie (and it's not just a Swiss thing :-) ) Your photos are delightful, creative work. They are unique and reveal your character, and they reflect your own vision as an artist. One can actually see you put a lot of thought and hard work into them and I salute this. In this way, I find your approach just as valuable as the one of someone simply snapping a picture and putting any old instagram filter on them (actually, I prefer your work!) - btw, this is also something I do sometimes! I really see Tookapic as a place of artistic freedom and as such, it should leave room for everyone's creativity - I really dislike the idea of censorship. So from my side, please keep on sharing those Tintin pictures!

jewels Whatever the right word is for it (and maybe censorship is not), Ron's question is about deleting his image in a project that he has been running for a long time. In my understanding, moderating is about ensuring that no one is offended by a post for example, which is very important and useful (and probably not easy at all to do). This being said, it is not really clear to me what makes Ron's work any different that some other pics which are heavily photoshopped for example. It is absolutely not my intention to offend anyone (and I do value this community way too much for that), but I still would be interested to understand what you feel made that particular pic/project inappropriate?

craig I am with jazzie and jewels. I have always enjoyed your Tintin series. I find it strange that after so many there is suddenly a problem.

jokele I also do not understand this sudden moderation. Ron took a picture and processed it in a photomontage (as he did for a while now, and until now it was no problem). He *took a photo* and it is part of his creative work. If he shows the result on a monitor, photographs the monitor and uploads the photo here, then it will be accepted - because now it is a pure-bred photo?

I've also enjoyed Ron's Tintin series and really hope he will (and can!) continue his work here.

I'm really thankful to the tooapic team for moderating the images, so we're not plagued by advertisements masked as a daily photo. But I think, the moderation is too strong here, because in my point of view he took his daily photo - and that is the goal here.

Nutt I'd like to jump in (with both feet!) to add my voice to the pro-Ron Dadoo Tintin project faction. This project has been going on for a long time, it's fun, creative, playful, smart and lovely to look at. It's created on the day it's posted. I don't understand what the problem is? For me it's part of what I love about Tookapic - some people take pictures of their dogs and post them as is (ahem, me today, for instance) and some people put a lot of time and energy into creating images that have a bit more post-prod work. That both (and all nuances within these two extremes) can be found within Tookapic has, for me, considerably enriched my Tookapic experience from day 1. Why limit it? And why suddenly delete one of the photos? Is only one person offended? If so, can that person just not follow Ron Dadoo and let the rest of us continue to enjoy his project?

Ron Dadoo I want to clarify one detail that may be the cause of this confusion. Pawel told me to send me an e-mail, about my Tintin theme, last March, I never received it ... so the fault may be to the spam filter or other ... ( Pawel: can you send me this message?)

Nevertheless, a problem of copyright could arise when we try to sell a photo where Tintin images, or any other copyrighted image or figurine, appear. Lawyers could explain better than me the limits of the copyrighted material and its diffusion.

This month @Paweł has taken my attention to the problem of logos or brand marks. He was absolutely right: we cannot sell images without agreement (or releases) if trademarked products appear.

Ron Dadoo This is very fair, that's why my Tintin images are never for sale and always protected by watermark. I know that the heirs Hergé are quite strict on the exploitation of the image ...

vera I think the same for the copyright! I love your pics Ron and they are so creative, there is no doubt!!! It's a great artistic work! And I also understand that it's hard that these things come out so late... I just can say that I know that if someone take a photo of my painting, he has to ask me before if he can do it, because of the copyright. Vice versa, I can't use a photography of somebody else to make my painting, without asking the permission to the photographer. That's why I started to make photos in fact!... I suppose that is the same problem with Tintin and Hergé?

vera I posted my next answer in the same time of you... I think that the copyright is applicated not only for the (financial) exploitation , but also for the reproduction of a piece of art. However I'm not a lawer and you have to find another professional opinion about it...

Ron Dadoo Does not copyright come from the moment you use to make money? At the time of the internet, do research on Tintin pastiches and you will be surprised how many have the right to ask for rights. Moreover from the moment you are visible to all there is necessarily a risk be captured, especially at the time of smartphones. Google: A creative common license is one of several public copyright licenses that enable the free distribution of an otherwise copyrighted work. A CC license is used when an author wants to give people the right to share, use, and build upon a work that they have created.

vera I just pay your attention, because it's legal regulation. For me, @Ron your work is fantastic and there is no problem, I even never think you don't make photography!!! Maybe there will be no consequences as mostly cases on the web... and that would be good! Maybe it's me who is too naive, or honest ... Satoshi T Sorry @vera . I think this issue is not a Copyright issue of Tookapic-Stock. The problem is the deletion of photo from Tookapic365. I have basically recognized that I can upload photos other than the prohibitions prescribed by the rules.
But this time, @Paweł emphasizes that "Tookapic365 is a place for *photo*".
Basically, our position is slightly different depending on whether Ron's unique method is included in the *photo* or not.

agnieszka bladzik in fact maybe @Paweł could explain exactly was was not ok so we all have better understanding what can or cannot be done, from the begging this topic is full of speculations.

and if it comes to photomergeing i always wonder if merged photos were all taken by author or somewhere just from the web, or if you publish it today were they taken today? etc. Just my strange thoughts. I did photo merge only few times and always did those photos the same day by myself
